This is their first album and they realize that torrents provide an excellent way to get their name out there. They will be releasing the album themselves and have provided the album themselves to the internets, so this is a completely legal download. All that is asked is that if you download it, pay a visit to their facebook or myspace page and spread the word!

I thought I should share for the good of the community and the REAL rights of the recording artists and their fans.

About a week or two ago, a band that I am acquainted to a few members of called Cynonyte out of North Carolina released their first album via torrent on their Facebook page. Since they are a small local band, they felt this was in their best interest long term instead of going the CD only route. The only requirement they had to their fans was to spread the word. I repackaged the torrent into a .ZIP file and uploaded the file to Mediafire.com since many people prefer direct downloads, I could spread the word to a wider audience and posted the link on their Facebook page as well (which they "liked"). A week or so (and 50+ downloads) later, I go back to check on the file to give an update to the band about how many people were getting to listen to their music and find the file had "removed from MediaFire for a violation of our Terms of Service or our Acceptable Use Policy". Curious to say the least since the band itself was fine and had encouraged this, and they are not signed by any record label and therefore are the sole owners of their music. After a few mails back and forth with the Mediafire support (who are not truly to blame in my opinion and were pretty helpful in fact) I finally got the copy of the "Official DMCA Takedown Notice"

The key here is the familiar link in the "Location of ORIGINAL WORKS" section. It is a link to this thread which is a post in to support the band (providing the links to the band's pages as well as the torrent and mediafire downloads). The "infringing" material consists of "'Cynonyte is a Winston-Salem, NC based Thrash/death metal band.. formed back in 2004... they have since opened for international acts like Scar Symmetry, Epica, Hypocrisy, Ensiferum, Blackguard, Silent Civilian, The Agonist to name a few...' - off their facebook profile" which is directly off of the band's Info page on their Myspace and Facebook pages.

It seems to me Mr. Walch did a google search of "Scar Symmetry" and did not actually read the post or verify it was truly infringing material.

P.S. As of now, the torrent provided by the band is still active
