Perched 10m above the ground on a wind monitoring tower, Australian farmer Peter Spencer today begins the 45th day of a hunger strike to protest against land clearing laws.

Ten years and more than 200 court cases after he began fighting legislation that prevents him from removing trees from Saarahnlee - his property near the New South Wales town of Cooma - he is now refusing to eat or budge until Prime Minister Kevin Rudd agrees to a list of demands.

Key to these is Spencer's contention that by refusing adequate compensation for laws blocking land clearing, Rudd is forcing farmers to pay the bill for Australia's Kyoto climate change commitments.

While courts, federal and state Governments and environmentalists reject the claims and Spencer's aerial hunger strike, his action has become a focus for climate change sceptics and opponents of laws impacting on private property rights.

The protest has also rubbed the Opposition's climate change nerves, still raw from the bruising battle over the Government's proposed emissions trading scheme that dumped Malcolm Turnbull from the leadership and installed Tony Abbott in his place.

This week about 300 supporters of the 58-year-old Spencer assembled outside Parliament House to demand action. Senator Bill Heffernan, a farmer and chairman of the Senate's select committee on agriculture, was jeered when he criticised Spencer and urged supporters to encourage him to end the hunger strike.

But Barnaby Joyce, a Queenslander who sits in the Senate for the conservative junior Coalition partner, the Nationals, was applauded for an attack on climate change agreements whose costs he claimed were met by working families.

The right-wing think-tank the Institute of Public Affairs joined in with its view that environmental laws are undermining property rights across Australia, listing 14 acts, regulations and planning policies "taking away landowners' rights to use their properties".

"The hunger strike of Peter Spencer, who is demanding compensation for the reduction in the value of his farming land by government regulations, highlights this serious issue," the institute's executive director John Roskam said.

"State governments are violating the basic right to property of thousands of landowners across the country [and] private property rights are human rights just as much as freedom of speech and freedom of religion."

For Spencer, land clearing laws have become a crusade.

This sounds like something I need to find more on.

From my basic understanding. Mr Spencer has debts owing on his farm, and wants to clear land so that he can crop and provide a larger income for his property so as he can finance his debt.

However he is unable to clear a large portion of his property due to the "stored carbon" in the trees and native vegetation.

Understandably, he is requesting compensation as a result of the governments hold over his property as a way of financing his debt
 
The legislation he's fighting came in long before "climate change" became a buzz word. It was originally introduced to stop soil erosion which was being caused by farmers clearing every tree that stood on their land, thereby removing the intricate root systems that prevented the topsoil flooding off everytime it rained.

Peter Spencer is on his 47 day of a hunger strike, in protest for the Native Vegetation Act 2003, has Not been contacted by PM Kevin Rudd and the Australian government seems to be reluctant to look for a solution and assist Mr Spencer and the many other farmers affected by the laws passed which has forced Peter Spencer to go on a hunger strike.

Peter Spencer in 2008 commenced Federal Court actions against the Australian government under section 51(xxxi) of the Australian Constitution which relates to acquisition of property on just terms as required by the Constitution.

On 26 August 2008, Justice EMMET of the Federal Court at Sydney made a Judgement against Peter Spencer as it was alleged that he may not have standing to sue the Commonwealth and orders for costs against Mr Spencer were made which it is understood are in the thousands of dollars. An investigation by Australinews has revealed.

On 8 September 2008 former deputy Prime Minister MARK VAILE from the Howard government, was appointed chairman and director of CBD ENERGY LIMITED. Mr Vaile had been Minister for Transport and Regional Development, Minister for Agriculture, Minister for Fisheries and Forestry and Minister for Trade.

CBD ENERGY LIMITED which has a number of Wind Electricity ventures in Australia and in the area of Cooma, is very interested in getting the property of Peter Spencer which it has been revealed is an ideal place to build a Wind Electricity farm. Mr Spencer in the past has try to build a Wind Electricity farm on his property but was forced to abandon the project due to red tape it has been revealed. Mr Spencer also tried to farm sheep and fish pond farming but due to the Native Vegetation Act was forced to abandon the projects as well.

Mr Spencer has since been unable to make a living from his property and has failed to meet his Mortgage repayments and it understood he would be evicted from his property by the Sheriffs any day. His hunger strike has attracted Missive Australian support from people all over Australia and many countries from around the World.

Since the first day of Peter Spencer hunger strike, PM Kevin Rudd has refused to meet with Mr Spencer but the Prime Minister has been seen at a Cricket match were he tried his hands at sport commentary, and has been seen meeting Cricket Team members attending a Dinner with the Prime Minster but the PM seems to be unable or unwilling to find time to meet Peter Spencer and look for a solution to the Australian farmers situation.

With the massive amount of information obtained by Australinews relating to the Federal Court cases of Peter Spencer and in relation to all the people that may be involved in these matters which day by day seem to be more of a case of Conspiracy to damage Peter Spencer and his attempts to get compensation on “Just Terms”, is not possible to give a full investigative report until all documents have been examined in more details and further investigation is conducted by Australinews into the motives of the people involved and of the Australian governments involvement in the passing of the Native Vegetation Act 2003 which it is alleged was passed by the Carr Government to assist the Howard government to reach the Kyoto Protocol on alleged Greenhouse emissions for which false and fraudulent documents and data has been used to deceive the Australian and World community into believing that Climate change exist. A number of leaked emails have revealed that the data has been fabricated by alleged scientist and sources have proved that that is the case.

Climate change does exist. What a terribly-written press release. I couldn't make sense of it. Climate change is happening. Just because various scientific bodies can't agree on how or why doesn't mean they think it's not happening.

The Howard Government weren't signatories to the Kyoto Protocol, so this statement is most likely a complete pile of shit.

THE NSW grazier who was on hunger strike for 52 days while up a tower on his property ignored a letter sent on behalf of Kevin Rudd during the protest.

Parliamentary secretary for water Mike Kelly tried to deliver a letter from Agriculture Minister Tony Burke to Peter Spencer after he began his strike up the tower.

Mr Kelly's office said the letter had been written on behalf of the Prime Minister, but it was returned unopened.
