Wow, are you serious? There are literally thousands of paintings with that similar composition. Stylistically, color-wise, and value-wise they are not similar at all. What you are doing is sort of like saying that Kayo Dot ripped off Miles Davis because they both use Trumpet when there are and were already THOUSANDS of music groups that use/d trumpet. And the second image isn't even remotely similar, not even conceptually.
