The new band featuring original EVANESCENCE members Ben Moody (guitar) and John LeCompt (guitar) and Rocky Gray (drums) along with "American Idol" powerhouse vocalist Carly Smithson has reportedly been slapped with a cease-and-desist notice over its use of THE FALLEN moniker.
