Hey artists, wanna make a CD cover for me without getting paid?!

hmm well the paintings over 100 years old, and bands use paintings all the time (see Candlemass). dun think anyone would care, but yur choice.

copyright is the BIGGEST thing any artist must look for FIRST AND FORMOST

I'm not naming names, but there is a band I know who keeps printing shirts from pictures they see in cool books/ or online... I told one of them before: that using someone else's work ESPECIALLY when creating something that makes $$$ is a HUGE lawsuit and they will lose... they didn't listen to me of course... I hope no one will find out..

with that being said Max, many paintings and images are "royalty free" and there are many stock-photo websites that have them and can sell them for a low price which is what most graphic designers use.
NO ONE that designs a CD is using anything that is copyright protected, unless they are VERY VERY stupid...

The picture in question, a quick google search will reveal:

^ they used some photo that some museum held the copyright for, but it faded out...

trust me, there is a band out there with shirts that can get them into a lot of trouble...
and for what? no shirt in the world is worth the hassle of copy-right law suit...
 
Copyright expires after a certain period of time, it applies to everything. There are stipulations, though.

No that's not entirely true.. . copyright is a very complicated issue....
some things never expire, and some things have a time limit...
with paintings and art work: copyright almost never expires... with graphic design - it depends on the contract...
When a band or anyone takes a painting or art work that was done by an artist and print it on shirts that can make them profit without paying for copyright rights: you're talking about thousands or even million of dollar law suits...

You beat me to it Karen :) I was just going to say some of this.

Even if your doing fan art of a long dead old master, I believe it's a courtesy to say After "dead artists name" then your own.

Copyright is so damn complicated that it almost stifles creativity in some cases. Especially if you love the shit out of vintage photo's like me, but I'm so glad they are there I would cry a thousand rivers if my work was robbed. I believe it used to be 75 years after the death of the artist, but next of kin gets a crack at renewal. Then there are some who buy the copyright. It's gotten all garbled in my head by now. But anyhow, everything Karen said is true it will catch up to you.

Here is a really good site, but some of them you need written permission to use, but it's not hard since their contact info is right there. It will state how the photographer wants their image used. Some want nothing more but to see what you did with the picture in order to use it.
But I cannot stress this enough, even if the person says that such and such picture is fair game to use for anything it is common courtesy to give positive feed back on their work. They didn't have to offer for free so I always like to say somthing good.

There is another sister site that is for profit. And it's not that expensive. The best stock is in there.
