Using a stock picture for your artwork is soooooo different from stealing another band's lyrics.

In all truth and honesty, I'd be shocked and amazed if DT even knew who Circus Maximus was, so I doubt this is plagiarism. And since the original unicycle guy is probably creative commons, it couldn't be anyways. I think it's just a hilarious coincidence. But who knows.

I don't ACTUALLY think they tried to plagiarize it. But if you're wondering, Dream Theater knows exactly who Circus Maximus is. An example here at around 4:05-ish:

It is a hilarious coincidence, but at the same time, it's kind of ironic that they are "copying" what a band that "supposedly copied" them. :lol: Like the hunter became the pray. Nothing but that.
 
Meh...the only fault that should be put on Dream Theater is that they hired a lazy artist. No big deal.

Not even lazy, really...no lazier than whoever designed the other cover. Just a guy who happened to use the same stock art as an artist who designed a cover for a band that coincidentally performs a similar style of music. Shit like this happens in publishing all the time.

I think so too.

Remember the opening to Queensryche's op:mc - "Dr. Blair, Dr. Blair, Dr. Jane Hamilton, Dr. Jane Hamilton" (if I remember the names correctly) - I've heard the exact same audio track as background noise on a soap opera and in commercials. I used to think "hey, the sound editor is a fan!" and then realized that it was probably stock audio.
 
Yes, part of that same doctor announcement is at the beginning of Motley Crue's Dr. Feelgood album ("Terror in Tinseltown.")
 
James' stock just dropped a shitload for me after he dropped this fellows name. The end of this song is utterly painful that I would use it to torture terrorists.

Happens all the time. Most of the time the band has no idea. I have seen tons of stock images reused, and altered ever since getting into graphic design/photoshop.

Here's one for ya off the top of my head.

That's exactly it. And yes, it happens in publishing all the time - I know that as I am part of the web/interactive team in a publishing company. As a matter of fact, I've been able to find that exactly image that both CM and DT artists used in the artwork. :lol:
 
Another example: If you watch the U.S. version of The Office, check out the motivational poster that's hanging just outside the bathroom. It features the same artwork as Marillion's "80 Days" single.
 
Yea, I remember when Nightwish released the cover art for Once and there was all this freaking out because they had copied some other album cover(s). Like the "Angel of Grief" image hasn't be copied, remade and repurposed a gazillion times before.
