RANCHO CUCAMONGA - A man suspected in the shooting death of a Fontana resident on Saturday morning has not been arrested because his actions might be classified as self-defense, sheriff's deputies said.
Shots were fired from a Honda Accord about 6 a.m. into a residence on Stafford Street in what deputies said appears to be a gang-related drive-by shooting.

A man returned fire and hit the Accord's driver, Johnny Maldonado, 26, who was pronounced dead at the scene from a gunshot to the upper body.

The man who fired the shots from the house has not been arrested. His name has not been released by police because it is a gang-related case.

"It's a definite possibility he was not arrested because of self-defense, based on the evidence," San Bernardino County sheriff's spokeswoman Cindy Beavers.

Homicide investigators will refer the case to the county District Attorney's Office to determine if charges will be filed.

Beavers said the Sheriff's Department does not determine if acts were made in self-defense.

The decision whether or not to immediately arrest someone is based on circumstances that surround the incident, or if officers think the District Attorney's Office should make that decision based on all the information, she said.
If prosecutors decide to pursue charges, they'll issue a warrant for the person's arrest, Beavers said.

Sheriff's deputies had responded about 6 a.m. Saturday to the area of Stafford and Center streets for a 9-1-1 call reporting shots being fired.

Deputies found Maldonado in the driver's seat of the Accord, which had come to a stop nearby.

During the deputies' investigation, it was determined that Maldonado and an unknown passenger shot into the residence on Stafford. The address has not been released.

"It appears the shooting began from the car into the house," Beavers said.

She confirmed that after shots were fired from the Accord, the man inside the house returned fire.

After the shooting, the passenger, who had a handgun, left the Accord on foot. The passenger has not been caught, Beavers said.

Hours before the shooting, there was an "altercation," between the people involved in the shooting, Beavers said. She had no further information about the earlier confrontation.

"This doesn't appear to be a random shooting," Beavers said.

TLDR: Some gangbangers do a drive by and then angry owner of the home pulls out his .308 and blows the drivers dome piece off. The passenger runs off, sheriffs department didn't know whether to press charges because clearly the home owner was acting in self defense.
