I've found a situation similar like this but with Abba.
A couple years ago a band called Abba Teens started to play Abbas old songs but with new pop sound.
But the original Abba didn't want them to have their name so they went to court and made Abba Teens change name to A Teens and that's their name today, but they don't play Abbas songs now, they have their own for now.

The bottom line is simple, when Oliver left Saxon and joint with Dawson, Gill and whoever they called themselves Son Of A Bitch (original Saxon moniker), when they discovered they couldn't achieve any kind of following or fame, they decided to leech on Saxon's established quality to make a living. Even is O/D win the court case and the name, who's going to follow them? Are they going to be able to found someone like Biff to move the people live? Are they going to be able to use the songs from "Unleashed The Beast" up to day? Can they use most of the material in "Solid Ball Of Rock" (composed by Nibbs Carter)?, the answers are NO, NO, NO, NO, NO, NO, NO, NO, NO, NO, NO, NO, NO, NO, and NO.

So they make have the name but they lack of everything else, there's only one real Saxon, and we know which is.
