I think he would/could because he actually IS the man behind the band. So they would at least have to change the name to go on.

hmmm.... i never heard of Stratovarius (TM) being a (C) copyrighted registered trademark of Timo "Everyone can fuck off" Tolkki (R) ....
and even if they do have to change the name, they could change it to "Stradivarius" that would be cool
