I came across this site when we released the Nex album back in 2007. I didn't bother to look into it any further then, but now when I saw our latest release there (Orcvus) I thought I'd contact them just to see what they had to say. I know it's totally pointless but what the hell....

Ok, I find it a bit annoying to see our releases available for download all over the web, especially when our sales are next to nothing nowadays, but what these clever little piss-ants have figured out is that they might as well charge for the stuff. And of course they are based in Russia so it's not much that can be done about it as far as I understand.

Anyway. After my first contact with them, in the form of a standard email I use for copyright infringement reports, they wrote back asking if I would like to make a deal with them for digital distribution. Yeah right...
So I wrote back that I wasn't interested and urged them again to remove the material. They replied, asking me for proof that I own the copyrights.
Well oh well, I sent them documents to prove it and they finally removed the album. So it actually DID work, but it was a pain in the ass.

What really annoys me is that they charge for the material; if they provided it for free, fine, whatever. Also, if you look at the information on the site, they say for example:

"In accordance to the licenses' terms mp3bay.org Inc pays license fees for all materials downloaded from the site subject to the Law of the Russian Federation "On Copyright and Related Rights"."

Why even bother to bring that up!? It's clearly just bullshit!

The reason why I'm posting this is that I thought some other people running labels here (if there are any) might find it interesting that their releases are most likely sold...SOLD on this site. Go to the site and make a search. Then feel free to go through all the trouble I had to just to get the stuff off the site. It's pointless, I know, but still...
 
I'm probably going to get flamed for this by someone... but I totally disagree with the whole mp3/torrent/whatever thing... nowadays even to the point where I dont download official music/software releases out of principle (and ISP download limits :lol:). I'd rather have a CD anyway because most of the mp3s on the net sound like shit and are ripped at stupidly low bit/sample rates. It fucking sucks that someone can go put all their time, effort and passion into making and recording music and then have their supposedly devoted, enthusiastic, loyal fans downloading it for free (or being illegitimately charged for it) from assholebay.com or wherever a week after its been released.
Also my experience with pirate software is that it never does what it says on the box and theres no comeback on it.
 
Piracy sucks.

I had similar problem with a website that had one of my parody bands song as ringtone... so i decided to download to my mobile and pay 1,20 € to see if it was true so I could report it to the law. My surprise is that the song was one of Ricky Martin. So they were cheating people.
i reported it to the consumer office.

But antipiracy in Spain also sucks

You know what? Some weeks ago there was a judgement in Spain to a pirate website and the judge said it was not a crime. So that means that it is legal is Spain.

Talking about this, the SGAE, a 'non lucrative' organization that is supposed to administer copyrights of the authors, with the help of the spanish government is charging taxes for every pendrive, HD, camera, mobile, CD-R, DVD-R... no matter what use will you make of i... you are condemned before you commit the crime... no matter you use DVD-R for your works backups or whatever...

This way many people in Spain say that with this taxes they are allowing you to download all you want cause you are paying for it.

But, where does this money goes to? As a member of SGAE I asked them and they told me it was delivered to the artist for selling list and polls. So the artist who sell more, they will earn more money.
What happens with my bands free 200.000 downloads? How many CD's were used, how many ipods... some thousand I guess.. and how much money did I earn = NOTHING, cause I'm not one of the top pop pretty faced spanish singers.
Rich bands are earning the money independent bands or smaller bands generate.

They own me 2.000 € as copyrights of a 20.000 copies CD compilation release since 2 years, i hate them. And all my songs in radios... haha, again, they are based in polls, not real playings... so i won't get too much money.

Sorry for using this thread to vomit my anger but I'm fed up, I think sooner or later I'll wave the flag of piracy on my boat, cause as musician I can't defend the ones who are supposed to defend me. I'm in no man's land.
