I'm totally sorry for ya!
It happend to me as well but it wasn't that total disaster, it was a small scratch fortunately, and it was fixed for 50 euro by me, refund sometimes is a pain in the ass it could have taken too long to ship it back to japan and checked by the japanese post.
The guitar shined again ;)
 
About 5 or 6 years ago, I successfully did the "swing the guitar around my body" trick with my jackson. I was amazed that I actually did it. Thinking I was the shit, I did it again and the result looked fairly similar to that picture. Luckily, it was a clean break so I glued the headstock back on and it's been fine ever since.

that's the classic weak spot of a guitar. a fall of 1-2 meters could produce that even in a hard case :(
 
That looks so clean that it'd surely be an easy fix for a professional, and it'd be good as new afterwards. I'd still try to get the refund though.

That part is actually one of the weakest parts of a guitar; that's why they build many guitar necks with volutes, so that part would be stronger. I've sometimes heard that nearly all older Les Pauls etc. have had that happen, since the neck is made out of mahogany (not exactly a very tough wood) and don't have volutes.

^^my thoughts exactly. I've snapped the neck on my LP twice and had it fixed. I know several dudes that have also snapped their Les Pauls. they are definitely the worst for that! like ze kink said, it's because of the mahogany. this leads me thing think of something I never considered for some reason.... should guitars be shipped with the strings removed/loosened? they would probably have to literally take direct impact to break, then, since there is no tension on the neck (except for the truss rod).
 
Guys - I just wanted to let everyone know that my refund was processed, no questions asked. Beatstreetmusic.com was REALLY helpful throughout the whole process. They tried to find another guitar to give me as a replacement, but they didn't have anything that really caught my eye, so the cash was sent back to me.

I am relieved...

When I got my Les Paul, I was bringing it back from Japan on the airplane. I was shit scared of this happening, coz I couldn't have done anything in that situation. Luckily, it was fine.
