Question about band name rights

Legendary NWOBHM band Serpent had the same problem, hence the changing of their name to Serpent (UK). Their career went kinda downhill after that. :(
 
This happens a lot. The Canadian band Fist changed their name to Myofist for UK release, Wrathchild changed their name to Wrathchild America, and the Angels were known as Angel City for a while in the US and UK so they wouldn't be confused with Angel. Even if you register your band name, it is only registered for the territory in which you register the name, which is why, at one point, there were three bands called Elysium in Australia: one in WA and two in NSW (only one of them was actually registered as a name). There was a band in Sydney called Mayhem until recently too. So you could call your band Kiss if you wanted to, because "kiss" is a generic word and can't be trademarked, even if their logo is. But that would be a pretty dumb thing to do.
 
Someone should start a band and call it "Metallica: no not that Metallica, a different Metallica, but Metallica all the same. What are you going to do? Sue us?" Imagine the chants at the show!

As if Metallica wouldnt sue them. They are probably going to sue you for using the name in your post phloggy :)

When they stareted, they called themselves "The Originals", then they found out about another band called "The Originals"

Anyone who doesn't have at least one Serpent (UK) album in their collection doesn't know REAL metal :kickass:

"Rise Of The Serpent" is a classic! Although you can only seem to find "Enter The Serpent EP" and "The Serpent Strikes Back" in 2nd hand stores over here.
 
I used to have Wrathchild (UK) album but it sucked. They had an awesome look though, one of the best band photos ever. It was a picture vinyl I had. Wish I didn't sell it for a few bucks now coz it was worth keeping just coz it looked so cool.
