it could be that is their plan, just not mentioned- kind of how amazon lets you pay for it but doesn't send it til the sale date- they just may omit that part.

but i've known small stores to sell before the release date- a small indie store i knew in chicago would sell stuff as soon as they got it from the distributor/record companies, even weeks before the release date. they'd quietly put it on the shelves, and run out quickly.
 
I noticed in the ordering section of kayodot.net that trexonline (aka The Record Exchange) is carrying it. I buy a lot of CDs there when I'm at home, because there's one within a half-hour of my house. Unfortunately, the Richmond area doesn't have a Record Exchange, and the closest store would either be the one near my house or maybe the one in Raleigh, NC, both of which would be a two hour drive each way.

I think I'm going to check out the local music store here this weekend to see if they are getting it in on the release date, which is a possibility because they usually carry a wide variety of genres and some more experimental stuff, and I bet they have several Tzadik selections in stock as we speak.
 
well technically they bought the copies to sell from Tzadik and seeing as how we are such a small artist i don't think there is anything illegal in what they are doing as long as Tzadik still gets paid. once they have the copies they buy to resell i think they can do what they want with them.
 
i think the big No-No about doing it comes more from major label types who want to keep the cds coming out on the same day in every store so as to track first week sales as accurately as possible. Because if some store starts selling the new Beyonce record a week before its release date then when they track her sales for the first week it may be off.

this is all just speculation.
