What would you guys do in this situtation?

OK so I recorded this band a few months back and got a song complete with them. We had booked dates and agreed upon a deposit, half now, the other half when the project is done for payment. Well they kept canceling on me over and over and caused me to loose tons of dates the could have been filled with other waiting bands. So, they told me that when they were ready they would resume recording during the spring. Well a week or so later they said they probably wouldnt be able to untill at least summer and if they couldnt that it was fine to keep the deposit and not resume recording. Now, today I get a message saying that they owe some people some money and now they need the desposit back. WTF seriously? I replied nicely saying that this is my business and we had an agreement and that that was months ago and has therefore been spent due to the agreement and told them that furthermore I would still honor the time paid for to record.

What the hell would you all do in this situation? I'm pretty upset about this...
 
I would do exactly what you did, Its not your fault that they cant keep to commitments, The deposit is for that exact reason, If they bail then you technically dont lose as much on wasted time. They are lucky enough that your even willing to honor them some time. I don't see that you did anything wrong there man
 
Easier said then done but try not to stress over it, Keep all documents in tact just to back yourself up and your in the clear, resume work, fill those empy spots!
 
Here was their message:

Hey dave, This is XXXXX From XXXXXXX XXXX i have been trying to text you for some time now and i dont know if your phone is off but i am just wanted to touch base with you as to where we are in our recording bit. We were goin to come back up over the summer to record but we have decided not to. We are sorry for not geting back to you sooner but we would like to have our money deposit we gave you back we need to pay off some people for shows. We are sorry for this. If you would like to call or text me and we can talk about this please call me at XXXXXXX

Here was my reply to them:

Well the money was a deposit for the project. I was also informed at an earlier date by one of you that If you decided not to come back the deposit was mine, which is how I normally deal deposits. Under normal circumstances if pre-arranged then that would be fine but I was informed to keep it and thus spent the money as this is my job and pays my bills, therefore, you booked and paid for time and cancelled all the time that was booked, so returning the deposit would mean that I booked slots only to loose money. We had an agreement. If you still want to record for the amount paid then I can fit you in.
 
I can hardly believe that people that retarded actually exist. Good on ye though, you did the right thing and handled it like a real pro. Fuck those douchebags.
 
You did exactly what you should have done, and then you where extra nice by saying that they could still record for what they paid for. You backed up your position with facts, they got no loop holes. Well done.
 
strange enough this happens a lot over here.
people don't take booking seriously. people skipping the booked date at last minute, people say their mother is dying, people say they ain't got money for the booked date... you booked before and then realize you don't have the money?
Later if they reply in a bad way, just text this two words, they always work:

FUCK OFF

Dude 1: "Dude, dude, we need money to pay these people and we're broke!"
Dude 2: "Dude, we paid that deposit for recording right? Can't we get that back?"
Dude 3: "Yeah dude, my brother rented a placed once and he had to put down a deposit, but he got it back since his place was all clean and shit."
Dude 1: "Yeah dude, we didn't even mess up the guys studio since we never went, we can totally get it back."

I don't do this myself because I'm a moron, but the common practice I've seen around here is that the engineer makes the band sign a contract which says that if the band cancels less than a week/two weeks/a month before the booked date, they will have to pay for the full sum that has been agreed upon. Might be something to consider in the future.

So in conclusion I backed them into a corner and they're gonna come finish as much as they paid for =) and if they cancel again i made it clear that money is still mine
