Why is scalping tickets on Ebay legal?

Scalping tickets is still illegal right? So how come you can get away with a 400% markup on Egay? I once had a friend that bought Tool tickets to some show in St. Louis, just so he could sell them on Etwat and make a big profit. That shit is fucked up.

i think it differs from state to state ...
in NYC ... you can only do a 10% markup.

one way to get around it is to sell something else ... like ... a TOOL CD and then give the ticket for "free" ... you know what I mean?

yes, it varies from state to state; Ebay is probably able to do it because there's nobody that wound up about busting one guy from scalping Tool tix.
