Boy, this soap opera kinda reminds me of the Anna Nicole Smith corpse custody battle: much ado about nothing.

I can't believe all this bullshit over a tiny internet icon created by a music fan. If creative controller for the estate of Paul Samson (deceased) had seen it on these message boards first, he probably wouldn't have thought twice. But he saw the blown up version on Myspace, an extremely commercial and popular site, where it looks like someone might be capitalizing on (or outright stealing) the Samson cover art.

A little research on his part and he would have realized that Gert's just a music fan, and not another band or artist looking to profit from a stolen trademark.

The damning part of the testimony was when the creative controller for the estate of Paul Samson (deceased) claimed "I think that you will find that I made no mention of suing or taking any form of legal action, just pointed out the facts."

As judge, I'd agree with that statement. However, the verbabage of that initial letter, while not threatening lawsuits, was clearly lawyer-speak. Only a lawyer can come up with a line that reads "...the Paul Samson logo is copyrighted, and is a registered trademark. It is an offence to deface a registered trademark, or to use without permission.
You may use the original logo without alterations as long as you credit it as copyright the Paul Samson Estate..." Normal people sure don't talk way, so the threat of lawsuit was certainly implied, if not stated outright.

My verdict is for the defense because the prosecution blatantly wasted the court's time and taxpayers money over nothing.

Gert, I think we all say harsh things when we are being harassed... so don't feel bad about telling somebody to "fuck off". It's natural to want to defend yourself.

When all is said and done THEY look bad, not you!
