Rising Records at it again. Mark Daghorn has done a runner!

Guy is a scumbag for sure, but what I don't understand is:

If there's a contract, then I'm sure that his commitments have to be fullfilled too, and they are written down in detail...So why did noone sue him for breaking a contract in the first place?
Sure, he has taken advantage of uninformed guys, but if noone was able to get money back in court, than he didn't do anything illegal I think?
Not to protect the bastard, or to give the fault to the victims, but things like that can easily be avoided with a bit of common sense, or not?

Most likely the contracts are shit. In fact, I'd like to see a proposal if anyone has one?

Sorry for the long text... but everyband who sends em a demo will get one of these.

Dear Beneath Contempt,

Thank you for sending your material to Rising Records. Have listened very carefully to it we are delighted to offer you a DIY album deal.

There are three ways the DIY deal can be structured – firstly, and our most popular option is a fifty fifty deal whereby the band pay for studio time only (subject to the album being recorded in our studios) and the label pays all other costs – profit is then split fifty fifty.

The second option is for the band to pay all costs with income being split seventy eight percent to the band and twenty two percent to the label (again, subject to the recording being done in our studios).

The third and final option is for the band to deliver a finished album to the label - in this instance we would then ask for you to pay for manufacturing and promotional costs, with the income being split eighty twenty in your favour.

In all cases the rights to the album masters remains the band’s.

We hope to move our bands from an initial DIY deal for the first album to a fully funded deal for subsequent albums but you would not be obligated to take the full deal if it is offered to you.

Here are some of our bands achievements:

The Dead Lay Waiting – Nominated for Metal Hammer and Kerrang awards in 2011, played the Metal Hammer Golden Gods gig boat in 2011, played Download festival in 2010 and 2011. Kerrang introducing feature for second album ‘Almost Heaven’, Video for ‘The Days I’m Gone’ playlisted on Kerrang TV, Scuzz TV and Lava TV, toured with Trigger The Bloodshed, Black Veil Brides and headlining.

Trigger The Bloodshed - Debut album 'Purgation' received rave reviews from all of the major metal magazines (4K Kerrang, 8/10 Metal Hammer, 7/10 Rocksound, 4/5 Big Cheese, 7/10 Terrorizer), and the band had an introducing feature in Kerrang, and incoming feature in Metal Hammer, a two page feature in Big Cheese and full page features in Terrorizer and Zero Tolerance.

Trigger toured in 2008 with Meshuggah, Cryptopsy, Beneath The Massacre,See You Next Tuesday, Dying Fetus and Suffocation, and played at Download Festival. The band were nominated in the Best Underground Band category at the 2008 Metal Hammer awards, and opened for Soulfly at one of Kerrang's week of rock shows leading up to the 2008 Kerrang awards.

A licensing deal for the USA, Canada, Japan, and Australia was signed with Metal Blade Records.

Second album ‘The Great Depression’ has seen major leaps forward in the band’s career, receiving even stronger reviews than their debut – 4K Kerrang, 8/10 Metal Hammer, 8/10 Rocksound, 8/10 Terrorizer, 4/5 Big Cheese, 4/5 Zero Tolerance, 4/5 Total Guitar. The band had a shared front cover of Big Cheese in March 2009, along with a three page feature, front cover of Terrorizer in April 2009, and a two page feature in Metal Hammer, April 2009.

Trigger were nominated in the best new band category at the 2009 Metal Hammer Golden Gods Awards, and tour supports that year included Evile, Devildriver, Cannibal Corpse, Behemoth, and Suicide Silence.

In 2010 the band released their third album ‘Degenerate’ to vast critical acclaim, and toured with Job For A Cowboy, Whitechapel, and Annotations of an autopsy as well as opening the second stage at Download festival.

Sworn Amongst – Strong reviews for debut album ‘And So It Begins’. Toured the UK and Europe in the 2008 Thrashing Like A Maniac tour. Supported Breed 77 on their UK tour in May 2009, and were main support to Annhihlator on their 2010 UK and European tour.

Second album ‘Severance’ was well received in 2010 and lead to features in Metal Hammer, Big Cheese, Rocksound and Kerrang, played Download festival 2011.

The Morning After – Licensed to JVC / Victor in Japan where their debut album ‘You Can’t Hurt Steel’ went in to the album chart top ten on first week of release, charting higher than Kiss and Dragonforce that week. Rising Records is distributed by Plastic Head Music Distribution worldwide. We are signed for physical and digital distribution and all of our CDs are available through all major chain stores, independent, and online retailers.

Rising Records was nominated in the best metal label category at the 2009 Metal Hammer Golden Gods Awards and over the last five years Rising artists have received seven Metal Hammer award nominations and two Kerrang nominations.

Four Rising bands played Download 2010 and five in 2011. Only Roadrunner records had more bands playing.

As a producer I have worked with Cradle Of Filth, Raging Speedhorn, Orange Goblin, One Minute Silence, Marillion, Fish, Robin Trower, The Dum Dums, Drugstore, Trigger The Bloodshed, The Dead Lay Waiting, The Morning After, Nex, Nato, Many Things Untold, and many more.

We are able to offer you discounted studio time in our residential studio, and free production services In general terms we prefer to keep the recording process in house as we are then able to give you a guaranteed release and keep quality control to the required level. We have two very well equipped residential studios, running pro tools HD3 and mix plus systems.

Studio rates are: £400.00 plus VAT per day fully residential (which includes studio time, me producing, an assistant engineer, catering, and accommodation) or £350.00 plus VAT per day residential but self catering.

We also have a residential studio on the Caribbean island of Barbados and can provide the studio at preferential rates to our label bands – why not combine recording with a vacation?

I'm sure that you will have a number of questions to ask so please give me a call on the above number to discuss and arrange a meeting.

I look forward to hearing from you.

Best regards,

Mark Daghorn

Please note that I am currently working out of our Barbados studio. The numbers are 001 246 271 5890 and 001 246 271 5882. We are five hours behind UK time (the same as US East coast time)

Might as well come clean that it was me who made the original thread and invented the fake Men With Ven band exposing him etc. Hopefully he won't send a hit squad to dispatch me while i'm buying groceries!

Good to see the final nail in the coffin has been hammered in to this scumbag.

He's completely fucked it. Game over!

Well done!

What a life this scumbag must lead.. sure he has some money now, but that won't last long.. and every day is a day he might be confronted with his deeds.

Guys,

Please be aware that the original Rising Records label established in 1980 in Sheffield UK is and has been, in business since then. When we first started we were registered with the Independent Label Association and are members of many trade organsiastions such as BPI etc.

We have no relationship or connection with the metal label associated with either Mark Daghorn or Clacton (UK). Mark Daghorn started that label in 2003, using our trading name and continued in spite of many representations from us. We have been at pains to dissociate ourselves with their business dealings and practices since he started.

We have now found it necessary to publish this disclaimer because of many contacts received by us from bands, musicians and traders disgruntled with the services or contact received from this other label.

We run our label as a non-profit making business geared towards helping out local musicians. We do not rip people off.

Please be sensitive to the fact that your references to Rising Records could affect our business and reputation. When referencing Rising Records, please ensure your comments distinguish between our label name and the one associated with Daghorn.

Thanks all. Good luck in your musical endevours and if you think we can help you, please contact us.
