Haha, got this message from Samson via Myspace ...

Hi,
I would just like to point out that the Paul Samson logo is copyrighted, and is a registered trademark. It is an offence to deface a registered trademark, or to use without permission.
You may use the original logo without alterations as long as you credit it as copyright the Paul Samson Estate, otherwise will you please remove it.

I don't understand this attitude at all. Certainly not from the "creative controller for the estate" of someone many of us have forgot and most of us never heard of.

It's not like it's a Samson SUCKS graphic, so how is it anything but a tribute to the man?

Well, got another message (suprise!) and they have indeed filed a complaint with Myspace... On top I got a message from Thunderstick (former drummer) who says I'll soon get a letter from his lawyer !!!! Haha, looking forward to that !!

In the mean time, can you guys give me a hand and spread the word Samson has a myspace were you are supposed to become friend of and than BASH them !!

You've got to laugh really - I think this is outrageous and is it really such a big deal Carnut that you're using the Samson logo without their permission. Its getting to the stage that sometimes I'm afraid to breath in the air in case someone wants to sue me for breathing their exhaled carbon dioxide hehe!!!

Good ol' bird started at MSP a bulletin and I followed. Using the logo is a sign of fandom and love, let's all support Carnut out of respect for Paul and Chris whose names are betrayed by this opportunist.

well i can see what they mean legal wise... since in a legal sense it is a intellectual property (i'm no lawyer but i think this is the correct word) ... but on the other hand you are not selling anything and are not profiting from the logo... so it's a grey area and i know carnut is our friend but perhaps its better to just credit them with the logo and get them off your back instead of losing your myspace page... i hope i don't tick anyone off with what i said... i'm just looking at it from the artist or the artist's estate point of view...
 
My friend's myspace got deleted for an imagine he had full permission to use, so it's a bunch of bullshit. They delete profiles without warning for the slightest things, and no chance is given for explanation.

I'm going to have to agree with UM here, they have the rights and from the sound of it they won't hesitate to take action. They may be assholes, but they call the shots as far as the logo goes. Better to find a new picture than to make a whole new profile.
 
I don't really care to make another profile, as I don't have a Mopar anymore anyway:) ... Legally they could be right, but do I earn money of it ...NOPE !!
Do they gain anything with handling their business this way ? NOPE ... I'm waiting for a new Samson release to review , they will loose BIG way by treating fans this way !!
If I were that artist I would be proud seeing my logo is still used, in stead of forgotten after 25 years....
Luckely I have a spare avatar, it's a Television kids show in Belgium, I think it fits the situation perfect !! (for the newer guys, my real name is "Gert")

I think they are pushing the envelope too much and threatening to sue you first is no way to treat a long time fan, listener and supporter of their band.

It would have been nice for him to thank you, kiss you, hell at least give a reach around while you're being totally screwed!

I am posting bulletins on myspace and hope to get some support. A band should know who and when to sue and not threaten someone for using an avatar.
 
Well, for a week or so I'm gonna change my Avatar and than put it back offcourse...Playing a little cat and mouse game, haha, meanwhile feel free to add comments to my blog !!!

Sorry to hear that you are angry.
The problem isnt that your friend used the Samson logo. If he had have done, then that would have been great. Unfortunately, what he did was to amend it for his own use by taking out the word "Samson" and inserting his own title, in which case it is no longer a tribute, but a form of theft.
His reply to my polite request to change it back or remove it was to tell me to "F*** off and sue me then".

Nice attitude.
