It's still technically illegal, so depends where your morals are. You could, however, ask the author/creator for permission and potentially get whatever you want for free - I've done it with various people for numerous things. Got permission to use a Meshuggah song for an artwork, unfortunately that work never got made... still, they were kind enough to say that they only wanted to see it and were happy for me to use it.
