Cannibal Corpse is being sued by soft-rockers metallica, due to their inclusion of the hidden track "no remorse" on their most recent album, "gore obsessed." A 5 million dollar lawsuit could cripple the band financially.

Metal Blade had been in negotiation with Elektra Records for a royalty rate for the use of the song. But Metallica was not pleased with the amount offered. The CD was ready for release prior to the negotiations being finished, and the band wanted it released as soon as possible, opting to make the song a hidden track so it wouldnt be such a "big deal" and a royalty rate would still be in the works.

Future repressings of this album will not include "No Remorse."

Does this have anything at all to do with Cannibal Corpse (henceforth CC) stealing Metallica's property? No.

Actually, CC hurt themselves when they used another band's song without permission. Metallica is merely using the laws designed to protect their property to do just that, protect their property.

Justin, you were replying to other posts right? if so to tell you the truth I highly doubt that cannible corpse could make more money off of a metallica cover. I'm sure they where paying homage to Metallica. It might cause more people to pirate an MP3 of it though . but seeing as how popular Metallica is I doubt any Metallica fan would buy the CD just because it has a metallica song on it. unless they realy like cookie monster or something. anyone who's a cannible corpse fan would buy it anyway. just my opinion. and even though this was all bullshit. I still think 5 mil would be realy shitty and blowing things way out of proportion. yeah it's wrong to steal a copywritten song but damn.... you'd have to be a big asshole to make them pay for it in the first place. I may be wrong but I don't realy think bands would make someone pay to do a cover of a song. like I said though I could be wrong.

Tribute or not, Metallica fans find out about everything. I'm sure there's a website somewhere listing every band that has covered Metallica. Do I care why they covered it? No.

Why? If it's worth it to the band to cover the song, they would be willing to pay for it up to a certain amount. I'm sure bands pay all the time to use cover songs. Maybe Motorhead didn't when they recorded "Enter Sandman," but they are friends of the band. Who knows about Anthrax covering "Phantom Lord."
