I didn't bother to watch his pitch video until I was informed that I'm in it (36s in, Soilwork shirt)...

I'll have it be known that I have no backing for this project, but since my picture at PPUSA most probably qualifies as public I can't really do anything about it. I don't endorse it, or terribly much appreciate it.

(I know what was meant, but it amuses me, as much the whole video does.)
 
then unless your face is blacked out, he legally can't use your face/likeness in his video...just FYI

That's not true. Photographers are not required to get legal release forms for photographing people in public areas, which a fest like PPUSA is, and even if it's not, it's very likely that a clause exists in the ticket buying addendum that contains your express release for your likeness to be photographed and used, and are able to use those images as they see fit.

I think he should provide you with some compensation for using your picture, like maybe he could let you be his employee for 6 months for only $2,500 (half price).

But that contract is probably only good between the party holding the event and the ticket purchaser (seller and purchases). Not some questionable vendor using it for his self-promotion sake.

Sorry, but I don't agree with it. If someone doesn't want their photo used by a photographer (or in this case, vendor), then it's simple... don't use it. :)

It looks like he should have gotten a model release for the use of that photograph, since it is being used for a commercial purpose. Not getting one opens himself up to a lawsuit, if the subject chooses to do that. To be honest, tho, it probably would be like getting water from a stone.

told ya he couldn;t legally use it. I have attorneys in my family :lol:
 
I think the crowd funding thing is really his in-ground swimming pool fund or something ;)

Either that or perhaps a travel fund to a beach hotel on the ocean with a blond and bottles of booze at sunset. At least that's that Zane's Indiegogo avatar currently depicts. Probably not the best image choice when you're asking for $25,000 from the public to absorb your business risks when you don't want to.
 
I'm going to close this thread up. I think I have given everyone ample opportunity to discuss this and left it for Zane to respond if he wished.

I don't see this going anywhere else.
