Amendment 10 - Powers of the States and People. Ratified 12/15/1791. Note

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Currently the Federal Government operates as though anything not prohibited to the Federal is open game, and the 10 Amendment specifically addresses this. Basically the Constitution doesn't mention very much in respect to the power of the federal government because the federal government shouldn't be doing very much. Everything not listed is supposed to be left to individual states.

An example of upcoming attempted and previously attempted legislation that this is probably aimed at would be something like:HR 1022, 110th Congress.

(iii) a barrel shroud or
(iv) can accept a detachable magazine outside of the pistol grip, and
(v) a semiautomatic pistol with a fixed magazine that can accept more than 10 rounds.

A semiautomatic shotgun with:
(i) a folding or telescoping stock,
(ii) a pistol grip (see definition below),
(iii) the ability to accept a detachable magazine or a fixed magazine capacity of more than 5
rounds, and
(iv) a shotgun with a revolving cylinder.

Frames or receivers for the above are
included, along with conversion kits.

Attorney General gets carte blanche to ban guns at will:

Under the proposal, the U.S. Attorney General can add any "semiautomatic rifle or
shotgun originally designed for military or law enforcement use, or a firearm based
on the design of such a firearm, that is not particularly suitable for sporting purposes,
as determined by the Attorney General."

Note that Obama's pick for this office (Eric Holder, confirmation hearing set for Jan. 15)
wrote a brief in the Heller case supporting the position that you have no right to have a
working firearm in your own home.

In making this determination, the bill says, "there shall be a rebuttable presumption that
a firearm procured for use by the United States military or any federal law enforcement agency
is not particularly suitable for sporting purposes, and a firearm shall not be determined to be
particularly
suitable for sporting purposes solely because the firearm is suitable for use in a
sporting event."

In plain English this means that ANY firearm ever obtained by federal officers or the military
is not suitable for the public.

The last part is particularly clever, stating that a firearm doesn't have a sporting purpose just because

it can be used for sporting purpose -- is that devious or what? And of course, "sporting purpose" is a
rights infringement with no constitutional or historical support whatsoever, invented by domestic enemies of the right to keep and bear arms to further their cause of disarming the innocent.

It got brought up here and there immediately following some responses by the Obama administration after remarks by Rush and others. Even if it never gets taken any further thats really a small issue compared to the current over-arching Federal behemoth.

Obviously the AZ HR hasn't passed yet, but the fact that 2 states are getting this bold tells me more states are going to follow suit. Mississippi just passed a bill specifically aimed against federal gun confiscation. Montana or another southern state will probably be next. I am just really surprised a north eastern state was the first to do it.
 
Point taken. I have to say, it would be nice to see the states assert themselves more, and bring the country closer to the 'social experiment' it was designed to be.

I agree completely. We have states for a reason. What is needed in New York is different than what is needed in Oklahoma etc etc. States need to take responsibility for the welfare of their own citizens and work within themselves for local solutions. Then they can branch out and assist others.

The only real purpose for the Federal Government was to regulate interstate relations (commerce, etc.) and provide for the common defense.

Russian and US satellites collide

The American civilian communications satellite Iridium 33 and the defunct Russian military communications satellite Kosmos-2251 collided over Siberia on Tuesday, according to NASA. The satellites, each weighing in excess of 1,000 pounds, and traveling at approximately 17,500 miles per hour, collided 491 miles above the earth.

The Iridium satellite was launched in 1997, and the Russian satellite was a Strela-2M model. The American satellite is expected to be replaced within the coming month as Iridium will maneuver one of its in-orbit satellites to replace the lost unit.

Although the first such satellite crash in space, such an event has been long predicted. Nicholas Johnson, chief scientist of NASA's Orbital Debris Office at the Lyndon B. Johnson Space Center stated, "We knew this was going to happen eventually and this is it — this was the big one."

While the International Space Station and the Hubble Space Telescope are at minimal risk, the event does raise concerns that the debris cloud could collide with other satellites in the region, triggering an exponentially growing series of collisions and debris known as an Ablation cascade.

The United States Strategic Command of the U.S. Department of Defense office is tracking the debris. The result of plotting analysis will be posted to a public website.
 
I think misinformation in mass media is a definite problem, but that fascistic crap sure isn't the solution.
 
Swiss Skinheads Attack Brazilian Pregnant Woman

GENEVA — Zurich police on Thursday were investigating an alleged skinhead assault on a pregnant Brazilian woman that caused her to miscarry twins and left her scarred with the initials of Switzerland's main right-wing party.

Details of the attack shocked the Swiss public and prompted Brazilian officials to suggest it was prompted by xenophobia.

Zurich police said details were not yet clear but a man called Monday evening to report that a woman at a Zurich train station needed help. When police found her, she had the letters carved into her skin and told them she had suffered a miscarriage after the attack.

Brazil's Foreign Ministry and Brazilian media reported that three skinheads, one with a Nazi symbol tattooed on his forehead, attacked the woman outside a local train station in Zurich while she was heading home. She had been speaking in Portuguese to her mother on a cell phone when she was accosted.

Brazil's foreign ministry expressed "great concern" about the attack in a hastily arranged meeting Thursday in Brasilia with a Swiss diplomats. Foreign Minister Celso Amorim urged Swiss investigators to act with "transparency" so both countries can learn exactly what happened,

"There is a very strong appearance of xenophobia," Amorim said. "The person was not robbed, apparently she was not raped. That shows there was another motivation."

Pictures of the smiling, pregnant woman were splashed across Brazilian newspapers Thursday next to those of a bare stomach and legs with the initials SVP _ presumably for "Schweizerische Volkspartei" (Swiss People's Party) _ clearly visible in several places.

The woman has been identified by family members as 26-year-old Paula Oliveira, a lawyer working for European shipping giant A.P. Moller-Maersk A/S.


"What they did to my daughter is like a horror movie," the woman's father, lawyer Paulo Oliveira, told Brazil's Globo TV. He said she was cut about 100 times in an attack that lasted 10 minutes.

The woman moved to Switzerland several years ago to work for Maersk, and was pregnant with twins and planning to soon get married, according to her uncle Silvio Oliveira.

The Swiss People's Party has taken a hardline against immigrants. It has spearheaded campaigns against Swiss integration in Europe and pressed to toughen asylum laws and make it easier to expel foreign nationals.

But the party is part of Switzerland's broad coalition government and has never had links to neo-Nazism.

"This is a country of law, where every human being deserves respect," Oskar Freysinger, a hardline nationalist lawmaker in the party, told The Associated Press. "If that really was someone from our party, we wouldn't hesitate for a second. That person would be immediately kicked out."

Brazilians reacted with outrage to news of the attack.

"I don't have any desire to go travel there now. I think that if the Swiss government doesn't stand up for what happened, then they are closing the door to Brazilians," said banker Samuel Mateus in Sao Paulo.

The Tenth Amendment of the United States Constitution, which is part of the Bill of Rights, was ratified on December 15, 1791, and states restates the Constitution’s principle of Federalism by providing that powers not granted to the national government nor prohibited to the states are reserved to the states and to the people. It is based on an earlier provision of the Articles of Confederation: “Each state retains its sovereignty, freedom, and independence, and every power, jurisdiction, and right, which is not by this Confederation expressly delegated to the United States, in Congress assembled.”

Washington, New Hampshire, Arizona, Montana, Michigan, Missouri, Oklahoma, California, and Georgia have all introduced bills and resolutions declaring sovereignty under the Tenth Amendment. Colorado, Hawaii, Pennsylvania, Arkansas, Idaho, Indiana, Alaska, Kansas, Alabama, Nevada, Maine, and Illinois are considering such measures.
