One time I was walking through the parking lot at a gig and a cop was busting a t-shirt bootlegger. Instead of arresting him or giving him a ticket, the cop took all the guys shirts away and then started giving them to people for free as they were walking to the gate.

I agree with you, if the band (& the label btw) are not concerned, they can't sell them. Risky thing.
