The copy protection scheme that is circumvented by the marker trick simply puts a garbage data track on the disc that tricks cd-rom drives into thinking they can't read the disc at all. Marking over the track makes it unreadable, making it basically invisible to the cd drive, and therefore allowing the drive to read the other tracks...
