Here's my suggestion ...

We put the tunes up on the site. We put it with the links for donation to one or more of Dio's charities. Let it go from there. I'm under the impression that if for any reason someone of importance was to take notice they would establish contact telling us to stop or in the very worst case, tell us we need to obtain the compulsory license and pay back royalties for whatever downloads may have already occurred ... at that point at least some kind of negotiation could possibly be started in which its explained that even though royalties were not payed per say, the tunes were only downloadable after a donation was made. I'm guessing here but its possible that anyone in a position to make the site or links be taken down would also be in a position to work something out because who is really gonna come out and say "stop making donations to Dio's charity"?

I think the thing that is key is to make it a NON-voluntary donation, make it mandatory. Doesn't have to be much ... $5 minimum or something

Aside from actually obtaining the licenses we need beforehand or completely forgetting the whole thing, that seems like one viable course forward

Its a tough thing to be sure ... I really don't think we're ever gonna get away with not paying those royalties somehow ... fact is, there were other people involved in the writing and creation of a lot of these tunes ... the licensing is there to make sure they would get their 1/2 cent per song play as well ... its a gamble but as we say at my job ... lets just try it and see if we get sued:lol:

the best thing is if we can at the very least, negotiate something if we're notified
 
If it feels like an issue there's always mediafire or torrents. Although I'm pretty sceptical we'll get into trouble, I don't think this will generate enough traffic to become noticeable.

What I really meant is since all efforts to establish some communication have met with silence, IF there is a chance that this would be picked up on someone's radar to where they felt the need to establish contact (even if to say "Stop") at least at that point we might be able to enter into some kind of negotiation. They would see that its strictly non-profit in regards to us, only $$$ involved is through donations to his charity ... I mean, if someone was gonna take it far enough to threaten legal action I would imagine that 1st there would be an option for "settling"

At that point they may indeed specify that we MUST have a license to continue, in which case again, we may be able to work something out in regards to the money being applied to the charity

The fact is we're taking a chance no matter how you slice it by proceeding without having the proper rights / licenses in question already. So as I said before, we either say fuck it and see what happens, or we bag the whole thing and just pass it all amongst ourselves like a big musical joint

Your company and my address is on the letters haha... so I'm just as involved as you..

But like Carlos said, I doubt we'll generate enough traffic to take significant notice and if we do a mandatory donation to a charity I think we'd be in a better situation to negotiate. I did make note that all the appearing musicians, as well as mixing, mastering, and studio time was donated to the project and that it's strickly non-profit when I re-sent the letters a while back.

I mean of course it's against the law and generally not a well seen thing among us but its for CHARITY, especially with the mandatory donation...
 
Ya that theory got thrown out the window when it came to "distribution".... technically we have to make sure that people wouldn't be able to download it outside those countries ... not worth the hassle.

Paulie how much are we talking to actually get the licensing for the songs?
 
I think it's sowhere in the range of $10-$15 a song for like 1000 or so downloads...

If there is no "official" release and the online album is free, I think we don't need even permission, we are not earning money with it!
And if we put a link to donate then what's the problem? We make people happy and contributing in an NGO.
 
I agree with Jevo. If there's no money involved nobody cares about this sort of stuff. BTW how many people got permission for cover songs posted in rate your mix section?
 
I'm agreeing with just releasing it, we've tried contacting them with no response, so really the worst they can do is tell us to stop or charge us somewhere between 100 and 150 dollars for the songs... and in that case I'll throw in some cash on that...

Are we releasing Monday?

Yeah, I think we all have learned much from it. I hope we'll do another tribute in the future and if we do - I'm sure we'll organize and implement it better.

Speaking about myself - I had a great pleasure collaborating with several great musicians. And the atmosphere among us all was really friendly and warm.

I guess I'll be the first to write something after Max's posting the link to the tribute album.It was pleasure and honor to be part of this project.This is one of the few big music projects I've ever worked.I wish I was better in mixing but I'm in music production only few years and this is the first time I have song mastered by professional.Thanks and God bless you all!!!
 
Honestly, this has been one of the most enjoyable music projects I've had in a long time. It was a true pleasure to work with all of you guys. Thanks to everyone for their hard work on this and thanks to you guys for giving me the opportunity to pay tribute to a true legend and work with some very fine musicians and individuals.

Max the mastering sampler sounds amazing! I can't wait to download the album. Great work buddy!

I couldn't agree more with Paul, this was by far the most enjoyable projects I've had! It was the first time I collaborated with online musicians and it was such an amazing experience, truly a pleasure working with all you insanely talented people! I hope we do this again... probably a tribute to the '80s metal or something like that!
