Do I Need a Mechanical License?

If you are manufacturing and distributing copies of a song which you did not write, and you have not already reached an agreement with the song's publisher, you need to obtain a mechanical license. This is required under U.S. Copyright Law, regardless of whether or not you are selling the copies that you made.

We would have to pay, per U.S. Law.. so that everyone knows. Unless we call up the individual copyright owners and have them agree to the charity terms or something...

Also, technically there is no true "stardard royalty rate" as you are allowed to negotiate your own fees and such with individual publishers, so I guess if we called/emailed them and negotiated that all profits went to Dio's cancer foundation they might forgo the royalty stuff.. *shrug*

I am booked solid for the next 2 weeks with bands, photos shoots, and video editing. Could someone get some form of legal doc started ti each of the publishers for each song and get the ball rolling on this.

Its all for nothing if we cant get the rights to distribute these songs.

I think we should put a hold on any more recording till we get the publishing / copyright stuff out of the way.

If you need a "legal" business name to put this stuff out under, you can use mine Metal Media Group LLC,

Jason, thanks a lot for offering to help with all the burocracy part of this, I really appreciate it dude.

Personally, I'm still up for finishing the songs, at the very very worst I would still at least pass it on to my friends as in "check out these dio covers we did", as I have had a shitload of fun working on the songs I've been on.

Anyways, If you manage to get the documents to see if we can negotiate the rights (as in doing it for free since it's all supposed to go to charity through voluntary donations, which means people wouldn't even pay for the album itself, that would just be a free download), please let us know!

I'd wait until the final product is finished... imagine it is a big turd, all efforts and legal work will be in vain.
If the tribute is good enough, then I would try to do it right asking for permission and all that shit.

Kinda backward logic considering recording the songs takes longer then drafting a letter....lol

Lol yeah, but recording the songs is sooo much more fun hahahaha

Seriously though, I don't think we should "halt" the recording and mixing of the songs, but if we do manage to get the permissions before finishing of course that's much better

Just spoke with the Pres of my company ... he knew Dio, they grew up in the same hometown and all and he was social with him ...

anyway, he's going up to his hometown this weekend and he's gonna talk to a few people about possibly getting us in some kind of direct contact with Wendy Dio .. I'm gonna say I know she can't do much about the situation with having to pay a certain amount per tune for the tribute cd and all. The idea is more to see if there is a way we could get the tribute officially "sanctioned" by the Stand Up and Shout Cancer charity, and maybe get them to cover the cost of it or maybe even a % of it

He'll let me know if he can find out something by next week

+1

I've got some experience with legal docs aswell and I offer what assistance I can give..

Ok guys, the time to be nazi has come.

I will now establish a board of bearded elders that will judge if a submitted track is of good quality enough to be admitted into the tribute album. This will be judged on performance (or editing, indifferent to us), mix, and probably even arrangements (if we think your idea in changing the song sucked, we might just not accept it, or if you did a totally exact copy of the original song, there's not much fun in that either). The board will be decided by democratic voting between me, my person and myself. I have voted. It will be very similar to the same "board of elders" of the backstage metal project:

Me
Carlos (SkinnyViking)
Jason (GuitarGuru77)
Jevo (Jevil)

Maybe 2 or 3 more guys when I make my mind, and maybe more if some of the mentioned decide to decline their admission to the board of elders (I love that title)

Ok and besides that, more nazi rules:

DEADLINE
AUGUST 31

Any track of which I have not recieved a final mix (still to be judged by the board) by that date will not enter the tribute album, unless notified of the delay with an understandable excuse with an understandable amount of advance time. Ok if your granny died and couldn't finish the mix I'll give you a chance, but you're not allowed to pull that card twice, even if you have two elderly grannies!

I think the voting should be open to the public. Let anyone who is a members of the forum vote.

I will also make the suggestion that this "voting elders" are not allowed to vote on the tracks they played on. That makes it a bit more fair.

I agree with your second thought and will make that a rule, but I'm not sure about the first one. The only point of this board is to determine if a mix actually too deficient to include it in the tribute (as stated before, if we decide the mix isn't good enough, we will give a short amount of time for the team to try to make it better either by remixing or changing the mixer alltogether), and judging from the awesome mixers we have here I really think and hope no song will actually have to be turned down because of this, it's really not about voting for "should we admit it?" because in default all songs are admitted, it's more of a quick checking to see if it's up to standard, so I really don't think a community voting for all songs is necesary, probably would take too long for what it's worth

Hail Dani!

I´ve just finished the vocals for "Stand up and shout!" AND I did a solo for the middle part. Now tell me brothers, who needs the wav files, who´ll mix it?

Do you want to do it? Machines and madness mixes are very good.
I wouldn't mind to give a try, in fact I did a quick mix, posted in the SUAS thread.
Vespiz is also doing some mixings I think.

BTW, if some lineup is still in danger of extinction due to some missing member or mixer, contact me, I can do guitars, mix and even bass.

Jevil, thank you very much! But I think, I will not mix it. Absolutely no energy for nothing atm. I´m glad, I finished the vocals and the solo today. YOU should mix it, dude.
