Lets get things back in perspective.....

We dont even know if we will be allowed by the Dio camp to do this. We have to wait and see what they say. This could take a week, it could take 6 months, we dont know.

As for selling vs donation. I have always been a believer in a voluntary donation process. I don't think anyone should HAVE to buy this compilation. It all comes down to this ... is this being done to raise money for charity, or is it being done to put your name out there and have people hear you. Lets hope its the former, cause anyone just jumping on this thing to say "Hey I was on a Dio compilation" should be shot, drawn, quartered, and tarred and feathered.

but isn't this dealing with when something is being sold for profit? The whole point being so that the original artist is receiving some kind of royalties for another performer's use of their song / material

setting this up as a non-profit, donation driven project ... do the same licensing rules apply?
 
Yes, we'll have to negotiate a license for every single tune with the respective copyright owners/administrators (publishers), no matter if money is involved (even for charity) or not.

Now we could simply license the songs through a service provider like Harry Fox (Songfile) or Rights Flow (Limelight). That's very convenient and easy but might end up quite expensive (depending on how many downloads we get) as we don't want to be compensated.

With Songfile or Limelight you pay a $15 processing fee per song for the license. On top of that, you pay mechanical royalties per distributed (downloaded) song.

The statuary mechanical rate depends on the length of the song:

But for that, we'll need to directly negotiate with every publisher of the respective songs.

* All this information is only viable if the files will be hosted in the US.
 
My favorite title would be, Heaven Through Hell: Ultimate Dio Tribute.

Imo the album should be free, with a voluntary donation.

as far as I know, the licence rules SHOULD apply also to free covers, however I guess it's quite difficult to "sue" them (see all the covers on youtube, also of people playing acoustic versions and singing etc.)
Maybe theres some way to "release" it directly through the cancer foundation?
 
I'm also just curious what it would all add up to ... cause I mean, there's like 30 of us. I'm willing to chip in

but also, maybe there would be a way that if we could get it officially condoned by the cancer foundation, because its non-profit and based off the idea of donations to the foundation, maybe they might cover the licensing cost

I don't know, thats a stretch I'm sure ... but possibly another idea
 
If you want to find out which publisher represents the track you did cover, you can use the Songfile search.

After that you can check this directory to find out which company the respective imprint belongs to and to get contact information for licensing.

An example: I did Sabbath's "Neon Knights", the publisher is "CROMWELL MUSIC INC." which is an imprint of "TRO Inc.". Now I could contact TRO via copyright@songways.com, asking for the license fee.

Hey sorry I was away for the weekend, at sonisphere Madrid, and yesterday crying over the world cup final.

We´re still waiting for songs to be finished, I´m gonna post a deadline soon, I´m thinking leaving it for half of august, and songs that aren´t finished by then are out (we have plenty songs)

Decimator, for now we´re not adding any more songs, but in case a couple songs end up unfinished you might get the chance to do a quick extra song.

About the copyright, I really don´t know what we can do about that. I could chip in if there is the need to pay something, but if it gets too expensive I don´t think we could make it, the point of this is to get donations for charity, but not to spend too much money on it
 
We can do it 2 ways.

1- Doing it for charity. Donations and money is involved, so we need legal permissions.
In my country, you need to pay 0,5 € for each manufactured CD, and declare the songs. The money of that copies will be delivered among all the authors.

2- Doing it for fun, upload on the internet. No money, so no copyright problem.
Doing covers is usually a problem when you earn money, cause the copyrights owners wants that money. But if there is no money, what the hell, nobody is gonna a end in prison.
 
Well, there is. the problem still is that "we" don't own the copyrights for the song, only for the performance.

And what can happen? We won't sell millions of copies, we won't earn a fucking penny, we are just a bunch of metalheads tributing our idol Dio and giving it free to the people who wants to hear it. If that is a crime i'm glad to go to prison.
